These Terms and Conditions apply to all purchases of goods from The Guitar Showroom, including vintage, acoustic, and electric guitars, whether purchased in-store, via our website (www.theguitarshowroom.co.uk), or through other sales channels. By placing an order, you agree to be bound by these terms.
3. Definitions
- Consumer: An individual purchasing for purposes wholly or mainly outside their trade, business, craft, or profession.
- Goods: Any guitars or accessories supplied by The Guitar Showroom, as described in our store, website, catalogues, or other advertisements.
- Order: Your order for goods, as submitted in-store, online, or via other means.
- Contract: The legally binding agreement formed when we accept your order, governed by these Terms and Conditions.
4. Product Descriptions
- We sell a curated selection of new, pre-owned, vintage, acoustic, and electric guitars and related accessories.
- We strive for accuracy in all product descriptions, including images, specifications, and condition (e.g., finish, wood grain, wear on used guitars). However, slight variations may occur, particularly with vintage or pre-owned items. If you have specific concerns about a product’s condition or specifications, please contact us before purchasing.
- For custom or special-order guitars, it is your responsibility to ensure the accuracy of any specifications or information provided.
5. Ordering and Contract Formation
- By placing an order, you confirm that you are legally capable of entering into binding contracts and are at least 18 years old.
- Orders placed online require you to check a box agreeing to these Terms and Conditions before checkout. In-store purchases may involve signing a sales agreement or acknowledging these terms.
- A contract is formed when we confirm acceptance of your order, either by email (for online purchases) or at the point of sale (in-store).
- We reserve the right to refuse or cancel an order if the goods are unavailable, incorrectly priced, or if we suspect fraudulent activity.
6. Pricing and Payment
- All prices are listed in British Pounds (GBP) and include VAT where applicable, unless otherwise stated.
- Prices are subject to change without notice, but changes will not affect orders already accepted.
- Payment must be made in full at the time of ordering, using accepted methods (e.g., credit/debit cards, PayPal, or bank transfer for online purchases; cash or card for in-store purchases).
- For online orders, payment is processed securely via our payment gateway. We do not store your payment details.
7. Delivery
- In-Store Purchases: Goods are available for collection at the time of purchase unless otherwise agreed.
- Online Purchases: Delivery is available to addresses within the UK and select international destinations. Delivery times and costs will be confirmed at checkout.
- Goods remain our property until full payment is received.
- We aim to dispatch online orders within 2-5 business days, subject to availability. Estimated delivery times are provided for guidance only and are not guaranteed.
- You must inspect goods upon receipt and notify us of any damage or discrepancies within 48 hours.
8. Consumer Rights (Distance Selling)
- If you are a Consumer purchasing online or via telephone (distance selling), you have the right to cancel your order under the Consumer Contracts Regulations 2013.
- You may cancel within 14 days from the day you receive the goods, without giving a reason. To cancel, notify us in writing (e.g., via email to info@guitarshowroom.co.uk).
- Return the goods to us within 14 days of cancellation, in their original condition, at your cost unless the goods are faulty or misdescribed.
- Refunds will be processed within 14 days of receiving the returned goods, including the original delivery cost (except for additional costs of non-standard delivery methods).
- This cancellation right does not apply to custom-made or personalized guitars, as these are exempt under UK law.
9. Returns and Refunds
- Faulty or Misdescribed Goods: If goods are faulty or not as described, you are entitled to a refund, repair, or replacement under the Consumer Rights Act 2015. Contact us within 30 days of receipt to arrange a return.
- Non-Faulty Returns: For in-store purchases or where distance selling rights do not apply, returns are at our discretion and may incur a restocking fee of up to 20% of the purchase price.
- Goods must be returned in their original condition, with all packaging and accessories, at your expense unless otherwise agreed.
- Refunds will be issued to the original payment method.
10. Limitation of Liability
- We are responsible for loss or damage caused by our negligence or breach of contract, but our liability is limited to the purchase price of the goods.
- We are not liable for indirect or consequential losses, such as loss of profit or opportunity, arising from your use of the goods.
- Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any matter that cannot be excluded under UK law.
11. Intellectual Property
- All content on our website, including images, logos, and descriptions, is the property of The Guitar Showroom or its licensors. You may not reproduce or use this content without permission.
12. Privacy and Data Protection
